A.     Minutes:

 

 1.     That the minutes of the July 12, 2012 and August 30, 2012 meetings of the Board be approved.

 

 

B.      Gifts, Grants, Agreements and Contracts:

 

1.    A gift to the Department of Biology from Carl Wozniak, Marquette, MI, large custom fish tank with stand, Refugium fish tank, custom biological filter, 1/3 hp Aqualogic pump, 1/15 hp Dolphin pump, triple pass protein skimmer, bag of marine salt, large saltwater light system with bulbs, refractometer, programmable pump controller, 2 power head pumps, 3 heaters, small pump, large box of filter materials, and miscellaneous chemicals and marine foods.

 

2.    A gift to the Department of Music from Mr. Ken Kilinski, Oak Lawn, IL, Baldwin Grand Piano (serial F132811).   ($12,000 value). 

 

3.    The grant from the Macomb Intermediate School District, to provide EMATHS (Embracing Mathematics, Assessment, and Technology in High Schools) professional development workshops for secondary mathematics teachers in the amount of $58,400, for the period of July 1, 2012, through September 30, 2012, under the direction of Ms. Debra Homeier.

D.     Property and Finance

 

  1.    The 2012-2013 Designated Fund Operating Budget be approved.  A copy of the budget is on file with the Secretary of the Board of Trustees.

  2.    The 2012-2013 General Fund Operating Budget be approved.  A copy of the budget is on file with the Secretary of the Board of Trustees.

  3.    The purchase of a 5.74 acre tower site owned by the Michigan Department of Natural Resources located in the Northeast ¼ of the Southwest ¼ of Section 9, Township 48 North,
Range 26 West, Negaunee Township, Marquette County, Michigan 49866, at a cost not to exceed $20,000.

  4.    The Financial Report for Northern Michigan University for the fiscal year ended June 30, 2012, and all related transactions be approved.  The audit of these statements was conducted
         by Rehmann Robson, Certified Public Accountants.  The statements were reviewed and approved by the Finance Committee of the Board of Trustees.  A copy of the Financial Report is
         on file with the Secretary of the Board of Trustees.

 

E.      Special Items

 

  1.  That the following Board of Trustees meeting schedule for calendar year 2013 be approved:

 

         Thursday-Friday, February 14-15, 2013

         Tentative (Retreat – May be held offsite)

 

         Thursday-Friday, May 2-3, 2013

         (Commencement Saturday, May 4)

 

         Thursday-Friday, July 11-12, 2013

  2.  A resolution to issue a charter to Experiencia Preparatory Academy to be opened in the fall of 2013. 
       This recommendation was approved by the Academic Affairs Committee on July 11, 2012.

 

  3.  The new academic building continue to retain the John X. Jamrich Hall name.

 

  4.  The Jacobetti Center be renamed the Jacobetti Complex effective October 1, 2012.

 

  5.  The following individuals be appointed as board members for the following Public School Academies:

  6.  The negotiated agreement between Northern Michigan University and the American Association of University Professors-Northern Michigan University Chapter covering the period from
       July 1, 2012 through June 30, 2015 be approved pending ratification by the AAUP membership on September 17, 2012, and that Dr. Paul Lang, Provost and Vice President of Academic
       Affairs, be authorized to sign the contract on behalf of the Board of Trustees.

 

  7.  The following restructuring within the Academic Affairs Division be approved effective September 24, 2012:

 

                        Admissions Office and Financial Aid Office will directly report to the Office of the President with functional supervision provided by the Provost and Vice

                        President for Academic Affairs

 

  8.  The revisions to the ASNMU Constitution be approved.  A copy of the Constitution is on file with the
       Secretary of the Board.

 

Rationale:  The All Student Judiciary (ASJ) will be renamed “Student Conduct Board.”  The Student conduct Board will be responsible for handling student disciplinary hearings only.  The Student Conduct Board will not be part of ASNMU, therefore, the ASJ will be changed to ASNMU Judiciary to make the distinction clear to all student and university members.

 

Article IV - Judicial Branch

1. All Student ASNMU Judiciary

The judicial POWER responsibility of the Associated Students of Northern Michigan University shall be vested in the All Student Judiciary ASSOCIATED STUDENTS OF NORTHERN MICHIGAN UNIVERSITY or other comparable student judiciary.

2. MEMBERSHIP AND Eligibility

Selection, eligibility requirements, and term of office of the Judicial Branch shall be in accordance with provisions of the Student Code.

ELIGIBILITY REQUIREMENTS OF THE ASNMU JUDICIARY SHALL BE IN ACCORDANCE WITH THE PROVISIONS OF THE ASNMU CONSTITUTION AND SUBSEQUENT BYLAWS.

THE ASNMU JUDICIARY SHALL CONSIST OF FIVE MEMBERS. EACH MEMBER WILL BE APPOINTED BY THE PRESIDENT OF ASNMU, FOLLOWED BY APPROVAL OF THREE-FOURTHS OF THE GENERAL ASSEMBLY. JUDICIARY MEMBERS’ TERMS ARE UP TWO ACADEMIC YEARS.

THE MEMBERSHIP OF THE ASNMU JUDICIARY SHALL PICK A CHAIR DURING THE FIRST OFFICIAL SESSION OF THE ASNMU JUDICIARY IN THE FALL SEMESTER.

3. Powers VACANCIES

The Judicial Branch shall have final jurisdiction in the following areas:

A. Questions of the constitutionality of decisions of the Associated Students of Northern Michigan University.

B. The constitutionality of any action taken by the Associated Students of Northern Michigan University and its committees.

C. Questions concerning the qualifications of any member of the Associated Students of Northern Michigan University.

D. Interpretations of the Constitution of the Associated Students of Northern Michigan University.

E. Appeals of complaints lodged with the Associated Students of Northern Michigan University Elections Committee concerning election and referendum procedures.

F. The All Student Judiciary is responsible to swear in all members of the Associated Students of Northern Michigan University.

SECTION 3.  VACANCIES

 

A VACANCY SHALL OCCUR WHEN A JUSTICE INFORMS THE CHAIR OF THE ASNMU JUDICIARY AND THE PRESIDENT OF ASNMU IN WRITING OF HIS/HER RESIGNATIONS OR IS REMOVED FROM OFFICE. VACANCIES SHALL BE FILLED BY PRESIDENTIAL APPOINTMENT AND APPROVAL OF THE GENERAL ASSEMBLY OF ASNMU.

 

SECTION 4.  RULES AND PROCEDURES

 

A. QUORUM

 

A QUORUM CONSISTING OF A MAJORITY OF THE ASNMU JUDICIARY MEMBERS SHALL BE NECESSARY TO CONDUCT ALL FORMAL BUSINESS. VACANT POSITIONS SHALL NOT BE CONSIDERED A PART OF THE TOTAL VOTING MEMBERSHIP FOR PURPOSES OF ESTABLISHING A QUORUM AND OTHER VOTING REQUIREMENTS.

 

B. MEETINGS

 

THE CHAIR SHALL CALL SESSIONS OF THE JUDICIARY IF HE/SHE DEEMS IT APPROPRIATE TO THE FUNCTIONING OF THE ASNMU JUDICIARY.

 

MEETINGS SHALL GRANT NO LESS THAN FIVE MINUTES FOR BOTH THE PLAINTIFF AND THE DEFENSE TO PRESENT THEIR CASES.

 

C. VOTING AND OPINIONS

 

EACH JUDICIARY MEMBER SHALL HAVE ONE VOTE, WITH THE EXCEPTION OF THE CHAIR. THE CHAIR SHALL VOTE ONLY TO MAKE OR BREAK A TIE.

 

THE CHAIR SHALL PROVIDE A WRITTEN OPINION OF THE JUDICIARY. THESE OPINIONS SHALL BE CONSIDERED PUBLIC AND AVAILABLE UPON REQUEST.

 

SECTION 5. POWERS

 

THE ASNMU JUDICIARY SHALL HAVE FINAL JURISDICTION IN THE FOLLOWING AREAS:

 

A.        THE CONSTITUTIONALITY OF ANY ACTION TAKEN BY THE ASSOCIATED STUDENTS OF NORTHERN MICHIGAN UNIVERSITY AND ITS COMMITTEES.

B.        QUESTIONS CONCERNING THE QUALIFICATIONS OF ANY MEMBER OF THE ASSOCIATED STUDENTS OF NORTHERN MICHIGAN UNIVERSITY.

C.        INTERPRETATIONS OF THE CONSTITUTION OF THE ASSOCIATED STUDENTS OF NORTHERN MICHIGAN UNIVERSITY.

D.        APPEALS OF COMPLAINTS LODGED WITH THE ASSOCIATED STUDENTS OF NORTHERN MICHIGAN UNIVERSITY ELECTIONS COMMITTEE CONCERNING         ELECTIONS AND REFERENDUM.

E.         THE ASNMU JUDICIARY SHALL BE RESPONSIBLE TO SWEAR IN ALL MEMBERS OF THE ASSOCIATED STUDENTS OF NORTHERN MICHIGAN         UNIVERSITY.
