Unpaid program staff.\u0026nbsp; Some volunteers are required to be vetted with a criminal background check and some are not.\u0026nbsp; See the background check requirements to discern whether the volunteer must be formally vetted with a criminal background check and\/or sex offender registry check.\u0026nbsp;\u003C\/p\u003E\r\n\r\n\u003Cp\u003E\u003Cstrong\u003EYouth athlete:\u0026nbsp;\u003C\/strong\u003E An individual who participates in an athletic activity and who is under 18 years of age.\u003C\/p\u003E\r\n\r\n\u003Cp\u003E\u003Cstrong\u003EYouth athletic activity:\u0026nbsp;\u0026nbsp;\u003C\/strong\u003EA program or event, including practices and competition, during which youth athletes participate in an organized athletic activity against another team, club, entity, or individual.\u003C\/p\u003E\r\n\r\n\u003Cp\u003E\u003Cstrong\u003EYouth program:\u003C\/strong\u003E\u0026nbsp;\u0026nbsp;Any class, camp, program, youth athletic activity, or other learning activity that includes participation by minors.\u003C\/p\u003E\r\n\r\n\u003Cp\u003E\u003Cstrong\u003EExclusions to Youth Programs:\u003C\/strong\u003E The term \u0026quot;youth program\u0026quot; does not include (1) private, personal events (e.g., birthday parties, weddings) that occur at University facilities, (2)\u0026nbsp;events open to the general public (e.g., intercollegiate athletic events, concerts), (3) Institutional Research Board (IRB) supervised research, or (4) other programs as may be designated from time to time by Public Safety and Policy Services in writing and added to the registration listing maintained by Risk Management. \u0026nbsp;\u003C\/p\u003E\r\n\r\n\u003Cp\u003E\u003Cstrong\u003EProgram Registration\u003C\/strong\u003E\u003C\/p\u003E\r\n\r\n\u003Cp\u003EAll youth programs must be registered every time the program is offered.\u0026nbsp; The initial registration form is available on the \u003Cstrong\u003Enmu.edu\/minorsoncampus\u003C\/strong\u003E website. \u0026nbsp;The initial registration form is completed by the Program Administrator.\u0026nbsp; When the initial form is submitted, the program administrator is automatically e-mailed with the information necessary to complete the registration process. \u0026nbsp;Risk Management maintains the public-facing website that shows the status of all university program registration.\u0026nbsp; Programs that have completed the initial registration form are given a status of Pending.\u0026nbsp;\u0026nbsp;When background checks are confirmed and the final attestations are checked on the Minors on Campus Portal, by the program administrator, the status is changed to Approved.\u0026nbsp; \u0026nbsp;\u0026nbsp;\u0026nbsp;\u0026nbsp;\u003C\/p\u003E\r\n\r\n\u003Cp\u003E\u003Cstrong\u003ECriminal Background Check Requirements\u003C\/strong\u003E\u003C\/p\u003E\r\n\r\n\u003Cp\u003EExcept for exclusions noted below, all individuals who have unsupervised access to minors at a youth program must have satisfactorily completed a criminal background check (including sex offender registry check) within the last twelve months. \u0026nbsp;The process is defined by Human Resources and the NMU Police Department.\u003C\/p\u003E\r\n\r\n\u003Cp\u003EIn addition, an external organization sponsoring a youth program on campus or using NMU facilities for a youth program must attest as part of the program registration process that all program staff working or volunteering at the program have been subject to a criminal background check (including the sex offender registry check) within the last twelve months.\u0026nbsp; The attestation is included in the Safety of Minors Addendum for the Facility Use Agreement.\u003C\/p\u003E\r\n\r\n\u003Cp\u003EThere are exceptions to the criminal background check requirement.\u0026nbsp; Specifically, the criminal background check requirements do not apply under the following circumstances:\u003C\/p\u003E\r\n\r\n\u003Cul\u003E\r\n\t\u003Cli\u003EThe youth program format requires the participating minor to be accompanied at all times by a parent, legal guardian, or other adult relative;\u0026nbsp;\u003C\/li\u003E\r\n\t\u003Cli\u003EThe PK-12 school administrator\u0026nbsp;has attested that they have conducted or will conduct their own background screening and training process; \u0026nbsp; \u0026nbsp;\u0026nbsp;\u003C\/li\u003E\r\n\t\u003Cli\u003ENMU students hosting siblings or other family members;\u003C\/li\u003E\r\n\t\u003Cli\u003ENMU students hosting high school students as part of a pre-enrollment visit for prospective students;\u003C\/li\u003E\r\n\t\u003Cli\u003ENMU students who volunteer under the direct supervision of an NMU employee\u0026nbsp;(e.g. student athletes during sports camps);\u003C\/li\u003E\r\n\t\u003Cli\u003EIndividuals under the age of 18 who volunteer or work under the direct supervision of an NMU employee;\u003C\/li\u003E\r\n\t\u003Cli\u003EExternal organizations using NMU facilities open to the general public are not required to provide certification of criminal background checks, even if minors are present. (e.g. the U.P. Builders\u0026rsquo; Show).\u003C\/li\u003E\r\n\u003C\/ul\u003E\r\n\r\n\u003Cp\u003E\u003Cstrong\u003ESex offender registry:\u003C\/strong\u003E\u0026nbsp; All persons who are subject to a criminal background check will also be reviewed for inclusion in the applicable sex offender registry.\u0026nbsp; In addition, NMU students who work\u0026nbsp;or volunteer unsupervised with youth or are present during youth programming overnight stays will be subject to a sex offender registry review.\u0026nbsp;\u003C\/p\u003E\r\n\r\n\u003Cp\u003E\u003Cstrong\u003ECriminal Background Check and Sex Offender Registry Results:\u003C\/strong\u003E\u0026nbsp; Individuals who do not have satisfactory criminal background check results will be provided with an opportunity to explain the results and give clarifying information to Human Resources and the NMU Police Department.\u003C\/p\u003E\r\n\r\n\u003Cp\u003EConfirmed inclusion on the sex offender registry will result in automatic exclusion from youth programming.\u0026nbsp; Human Resources and NMU PD\u0026nbsp;will review the results of other background check verification and any clarifying information and make a determination as to whether the individual being assessed will be allowed to work with youth. \u0026nbsp;Fair Credit Reporting Act adverse action processes will be followed.\u0026nbsp;\u003C\/p\u003E\r\n\r\n\u003Cp\u003E\u003Cstrong\u003ETransporting Minors \u0026ndash; Driving History Screening\u003C\/strong\u003E\u003C\/p\u003E\r\n\r\n\u003Cp\u003EThe program administrator will ensure that program staff who transport youth will be subject to a review by the NMU\u0026nbsp;Police Department, that\u0026nbsp;may include requirements that the driver must:\u0026nbsp;\u003C\/p\u003E\r\n\r\n\u003Cul\u003E\r\n\t\u003Cli\u003Ebe at least 19 years of age;\u003C\/li\u003E\r\n\t\u003Cli\u003Ehave been subject to a Michigan driver records check\u0026nbsp;within the last twelve months;\u003C\/li\u003E\r\n\t\u003Cli\u003Ehave a valid driver\u0026rsquo;s license;\u0026nbsp;\u0026nbsp;\u003C\/li\u003E\r\n\t\u003Cli\u003Enot have three or more convictions for moving violations within the past 36 months;\u0026nbsp;\u0026nbsp;\u003C\/li\u003E\r\n\t\u003Cli\u003Enot have been convicted of operating a vehicle while under the influence of alcohol or drugs, leaving the scene of an accident, failure to report an accident, driving with a suspended license or reckless driving within the past 36 months; \u0026nbsp;\u0026nbsp;\u003C\/li\u003E\r\n\t\u003Cli\u003Enot have been convicted of obtaining a vehicle unlawfully, possessing a stolen vehicle, or using a vehicle in a crime or in connection with an unlawful act.\u003C\/li\u003E\r\n\u003C\/ul\u003E\r\n\r\n\u003Cp\u003EAny discrepancies will be reviewed by the NMU\u0026nbsp;Police Department.\u0026nbsp;\u0026nbsp;Exceptions to the requirements may only be waived by the NMU Police Department.\u0026nbsp;\u003C\/p\u003E\r\n\r\n\u003Cp\u003EThe use of private vehicles for transporting minors should be avoided. When private vehicles must be used, contact Risk Management; proof of automobile liability insurance must be delivered to Risk Management.\u0026nbsp;\u003C\/p\u003E\r\n\r\n\u003Cp\u003EMore than one program staff must be present in the vehicle, except when there are multiple minors for the duration of the transportation.\u003C\/p\u003E\r\n\r\n\u003Cp\u003E\u003Cstrong\u003EMinors on Campus Code of Conduct(s)\u003C\/strong\u003E\u003C\/p\u003E\r\n\r\n\u003Cp\u003EClarifying Note: There is a Code of Conduct for program staff and a code of conduct for participants.\u003C\/p\u003E\r\n\r\n\u003Cp\u003E\u003Cstrong\u003ECode of Conduct for Program Staff\u0026nbsp;\u0026nbsp;\u003C\/strong\u003E\u003C\/p\u003E\r\n\r\n\u003Cp\u003EOur goal is to provide the highest quality program in a safe environment for every participant. \u0026nbsp;Please assist us in maintaining a safe and enjoyable environment by following the Code of Conduct, below:\u003C\/p\u003E\r\n\r\n\u003Cp\u003EProgram staff should be positive role models for minors and act in a responsible manner. It is expected that all program staff will adhere to the below expectations.\u003C\/p\u003E\r\n\r\n\u003Col\u003E\r\n\t\u003Cli\u003EAnyone who knows, suspects, or receives information indicating that a child or teen has been abused or neglected, or who has other concerns about the safety of children or teens MUST inform the program administrator, the NMU Police Department (906 227-2151) or the Michigan Department of Human Services at (855) 444-3911.\u003C\/li\u003E\r\n\t\u003Cli\u003EDo not engage in any sexual activity, make sexual comments, tell sexual jokes, share sexually explicit material with minors, or assist in any way to provide access to such material to minors.\u003C\/li\u003E\r\n\t\u003Cli\u003EDo not engage or allow minors to engage you in romantic or sexual conversations or related matters. Similarly, do not treat minors as confidantes; refrain from sharing sensitive personal information about yourself. Examples of sensitive personal information that should not be shared with minors are information about financial challenges, workplace challenges, drug or alcohol use, and romantic relationships.\u003C\/li\u003E\r\n\t\u003Cli\u003EDo not touch minors in a manner that a reasonable person could interpret as inappropriate. \u0026nbsp;All personal contact should generally only be in the open, and in response to the minor\u0026rsquo;s needs, for a purpose that is consistent with the program\u0026rsquo;s mission and culture, or for a clear educational, developmental, or health-related purpose (e.g., treatment of an injury). Any refusal or resistance from the minor should be respected.\u003C\/li\u003E\r\n\t\u003Cli\u003EDo not shower, bathe, or undress with, or in the presence of, a minor.\u003C\/li\u003E\r\n\t\u003Cli\u003EProfanity, vulgarity, or harassing language is prohibited.\u003C\/li\u003E\r\n\t\u003Cli\u003EDo not be alone with a minor. If one-on-one contact is required, meet in open, well-illuminated spaces or rooms with windows observable by other program staff.\u003C\/li\u003E\r\n\t\u003Cli\u003EDo not meet with minors outside of established times for program activities. Any exceptions require written parent\/guardian authorization and must include more than one program staff.\u003C\/li\u003E\r\n\t\u003Cli\u003EDo not invite minors to your home or other private locations. Any exceptions require authorization by the program administrator and written authorization by a parent\/guardian.\u003C\/li\u003E\r\n\t\u003Cli\u003EDo not provide gifts to minors or their families independent of items provided by the program.\u003C\/li\u003E\r\n\t\u003Cli\u003EDo not engage or communicate with minors through email, text messages, social networking websites, phone, internet chat rooms, multiplayer online games, or other forms of social media at any time except and unless there is an educational or programmatic purpose and the content of the communication is consistent with the mission of the program and the university. \u0026nbsp;Should communication be necessary, include a third person.\u003C\/li\u003E\r\n\t\u003Cli\u003EDo not engage in any abusive conduct of any kind toward, or in the presence of, a minor, including, but not limited to, verbal abuse, striking, hitting, punching, poking, spanking, or restraining. If restraint is necessary to protect a minor or other minors from harm, all incidents must be documented and disclosed to the program administrator and the minor\u0026rsquo;s parent\/guardian. \u0026nbsp;All incidents involving such conduct must be documented and disclosed promptly to the program administrator.\u003C\/li\u003E\r\n\t\u003Cli\u003ENMU is a tobacco-free campus; the tobacco-free policy is available online. \u0026nbsp;Do not use, possess, or be under the influence of alcohol or illegal drugs while on duty, or in the presence of minors involved in a program, or when responsible for a minor\u0026rsquo;s welfare.\u003C\/li\u003E\r\n\t\u003Cli\u003EPossession or use of any type of weapon or explosive device is prohibited unless authorized in advance by campus law enforcement.\u003C\/li\u003E\r\n\t\u003Cli\u003EDo not provide alcohol or illegal substances to a minor.\u003C\/li\u003E\r\n\t\u003Cli\u003EDo not provide medication to a minor unless authorized by the program\u0026rsquo;s medication management guidelines.\u003C\/li\u003E\r\n\t\u003Cli\u003EWhen transporting minors, more than one program staff from the program must be present in the vehicle, except when multiple minors will be in the vehicle at all times through the transportation. Avoid using personal vehicles if possible and comply with the program\u0026rsquo;s transportation guidelines. All incidents involving such conduct shall be reported to the program administrator.\u003C\/li\u003E\r\n\t\u003Cli\u003EDo not tell minors, \u0026ldquo;This is between the two of us,\u0026rdquo; or use similar language that encourages minors to keep secrets from their parents\/guardians or for you to keep secrets from the program administrator.\u003C\/li\u003E\r\n\t\u003Cli\u003EProgram staff may not take pictures of minors or post information about minors to social media sites without permission from a parent\/guardian and the program administrator.\u003C\/li\u003E\r\n\t\u003Cli\u003EWhile this code contains specific rules, there is also an expectation that if program faculty, staff, volunteers or others witness a violation of these rules that they will act immediately. \u0026nbsp;\u0026nbsp;For instance, if you witness any program staff\u0026nbsp;isolating a program participant, speak up, bring the participant back to the group, or take other appropriate action and remind all participants of the code rules designed to keep all persons safe. \u0026nbsp;Further, you must report the incident to the program supervisor so that further action can be initiated if necessary.\u003C\/li\u003E\r\n\u003C\/ol\u003E\r\n\r\n\u003Cp\u003EIndividuals associated with a youth program alleged to have violated NMU policies or conduct rules of the program will be reported to the NMU Police Department for possible dismissal and removal from the program.\u003C\/p\u003E\r\n\r\n\u003Cp\u003E\u003Cstrong\u003EParticipant Code of Conduct\u003C\/strong\u003E\u003C\/p\u003E\r\n\r\n\u003Cp\u003EOur goal is to provide the highest quality program in a safe environment for every participant.\u0026nbsp; Please assist us in maintaining a safe and enjoyable environment by following the Code of Conduct, below:\u003C\/p\u003E\r\n\r\n\u003Cp\u003E\u003Cstrong\u003EWe will:\u003C\/strong\u003E\u003C\/p\u003E\r\n\r\n\u003Cul\u003E\r\n\t\u003Cli\u003ELearn and follow the rules.\u003C\/li\u003E\r\n\t\u003Cli\u003EBe respectful of the feelings and properties of others.\u0026nbsp; Show others courtesy and treat them the same way that we want to be treated.\u003C\/li\u003E\r\n\t\u003Cli\u003EShow respect to the staff and cooperate with their instructions and rules.\u003C\/li\u003E\r\n\t\u003Cli\u003ECommunicate with others in an appropriate manner. We will not use foul words, vulgarity, or harassing language.\u003C\/li\u003E\r\n\t\u003Cli\u003ENever verbally or physically harm other participants and\/or staff.\u003C\/li\u003E\r\n\t\u003Cli\u003EUnderstand that any form of violence, including pushing, kicking, hitting, or fighting is unacceptable and will not be tolerated.\u003C\/li\u003E\r\n\t\u003Cli\u003ERespect privacy.\u0026nbsp; Using cameras, imaging, or digital recording devices is prohibited near showers, restrooms, or other areas where privacy is expected.\u003C\/li\u003E\r\n\t\u003Cli\u003EUse the buddy system.\u0026nbsp; Each participant\/camper will be accompanied by another participant\/camper at all times. \u0026nbsp;\u003C\/li\u003E\r\n\t\u003Cli\u003EUse equipment and supplies in an appropriate manner.\u0026nbsp;\u003C\/li\u003E\r\n\t\u003Cli\u003EStay in safe areas.\u0026nbsp; Don\u0026rsquo;t leave the building or areas designated by your program supervisor or staff.\u0026nbsp; When moving across campus and crossing streets, only cross in the designated crosswalks.\u003C\/li\u003E\r\n\t\u003Cli\u003ETell an adult if you or someone else is hurt or injured.\u003C\/li\u003E\r\n\t\u003Cli\u003EStay until it is time to go.\u0026nbsp; Participants are to remain in designated areas on campus for the duration of the program unless program activities require otherwise. \u0026nbsp;If a participant needs to leave campus for some reason, the program administrator must receive written permission from the parent or guardian and grant specific permission.\u003C\/li\u003E\r\n\t\u003Cli\u003EBe fully responsible for our actions and understand the consequences of any inappropriate actions.\u003C\/li\u003E\r\n\u003C\/ul\u003E\r\n\r\n\u003Cp\u003E\u003Cstrong\u003EOther NMU Rules:\u003C\/strong\u003E\u003C\/p\u003E\r\n\r\n\u003Cul\u003E\r\n\t\u003Cli\u003ESexual abuse or harassment will not be tolerated.\u003C\/li\u003E\r\n\t\u003Cli\u003EHazing, bullying, and cyber bullying will not be tolerated.\u003C\/li\u003E\r\n\t\u003Cli\u003EPossession or use of weapons or explosive devices is prohibited; NMU Police Department exceptions are allowed.\u003C\/li\u003E\r\n\t\u003Cli\u003EMisuse of internet privileges is prohibited.\u0026nbsp; Attempting to access unauthorized sites will not be tolerated.\u003C\/li\u003E\r\n\t\u003Cli\u003ETampering with fire equipment, security equipment, or locks is prohibited.\u0026nbsp; This includes fire extinguishers, fire alarms, smoke detectors, etc.\u003C\/li\u003E\r\n\t\u003Cli\u003EVandalism and pranks are prohibited. \u0026nbsp;Misuse of equipment and damaging property is prohibited.\u0026nbsp; Any damage caused will be charged to the responsible party. \u0026nbsp;All furniture must remain unchanged and kept in place.
