Description |
Prohibits the inclusion of deceptive or misleading information and subject headings, requires identifying information such as a return address in email messages, and prohibits sending emails to a recipient after an explicit response that the recipient does not want to continue receiving messages. In addition to bulk email, the law covers all commercial messages, which it defines as any electronic mail message the primary purpose of which is the commercial advertisement or promotion of a commercial product or service. Each separate email in violation of the CAN-SPAM Act is subject to penalties of up to $16,000. |
