U.S. Asks Supreme Court for Partial Relief From Title IX Injunction
"The provisions at issue in the lawsuit strengthen protections for LBGTQ+ students in part by clarifying that sex-based discrimination prohibited under Title IX includes discrimination based on sexual orientation or gender identity. Under the final regulations, transgender students are able to use the bathroom that aligns with their gender identity without fear of discipline—a point of contention for the plaintiffs. Additionally, referring to a student with the wrong pronouns could violate Title IX if the conduct is so 'sufficiently severe or pervasive' that it prevents them from participating in or benefiting from an educational program or activity."

The Education Department is appealing lower court decisions temporarily halting the rule over its LGBTQI+ protections, but wants to enforce other parts.
"In a pair of filings, U.S. Solicitor General Elizabeth Prelogar asked the court to review the preliminary injunctions arising from cases in Louisiana and Tennessee after both the 5th and 6th Circuit denied the Biden administration’s request to allow portions of the rule to take effect. On its face, this might not appear to implicate trainings on antisemitism. But as a legal matter, Title VI of the Civil Rights Act of 1964 protects Jewish students (as it does Palestinian students) because those groups are understood in terms of ethnicity and shared ancestry. So while it might not be obvious, Texas’s anti-DEI law creates a barrier for antisemitism programming—just as it does for programs “designed or implemented in reference to” anti-Asian racism, anti-Black bias or anti-LGBTQ bigotry."

OCR complaints have nearly tripled since 2019 and are already up by 24 percent in 2024. Much of the increase is due to complaints alleging discrimination against LGBTQ persons, but complaints about racism and ableism remain high. And while two-thirds of the complaints involved K-12 schools, that leaves a third for colleges. Given that the number of K-12 schools (139,069) eclipses the number of postsecondary schools (5,916) by a factor of more than 20, this 2:1 complaint disparity means that complaints are far more pervasive in higher education."

Goldwater Institute Sues Arizona Regents Over DEI Training
