A public employer needs to have a majority vote each year, if they are choosing the 80/20 percentage requirements of Section 4 of the Act (MCL 15.564) instead of the “hard cap” requirements of Section 3 of the Act (MCL 15.563). Section 4(1) (MCL 15.564(1)) of the Act, that provides the 80/20 percentage option, directs that “[b]y a majority vote of its governing body each year, prior to the beginning of the medical benefit plan coverage year, a public employer, excluding this state, may elect to comply with this section for a medical benefit plan coverage year instead of the requirements in Section 3...” (MCL 15.563). |
